Orders and Cancellations  

Our Contract
All orders submitted to Nivin Gifts and Party constitute an offer to purchase and are subject to acceptance by us. We reserve the right to reject any order at our sole discretion and are not obligated to provide reasons for doing so. If an order is rejected, any payments received will be refunded in full via the payment method used. A binding contract between you and us will only be established when we commence processing your order.

Payment Methods
We accept payments via Visa, MasterCard, American Express, debit cards, and PayPal. To ensure security, all payments are securely processed through Stripe payments.

Refunds and Returns Policy  

Damaged Goods
We take great care in packaging our products to ensure they arrive in excellent condition. However, if your order is damaged in transit, please contact our Customer Service team at [Insert Customer Service Email] within 24 hours of receipt. You must provide photographic evidence of the damage to qualify for a refund or replacement. If approved, you may choose either a free replacement on the next available delivery date or a full refund. Refunds will be processed within three business days, but your bank may take an additional 3–5 days to reflect the refund.

Non-Delivery
If your order does not arrive on the scheduled delivery date, we will either send a free replacement on the next available delivery date or issue a full refund within three business days. Please note that banks may take an additional 3–5 days to process refunds to your payment method.

Returns
Due to the perishable nature of balloons, we are unable to accept returns for these products. For accessories, returns are accepted within 14 days from the order date, provided the items are in their original condition. Refunds will include the cost of the items and the standard delivery fee. Customers are responsible for the cost of returning the products.

Fraud Prevention  

We reserve the right to cancel orders or close customer accounts in cases of suspected fraud. If a fraudulently obtained gift card is redeemed or used, we may charge the payment method on file to recover the value.

Balloon Availability and Substitution  

All balloon products are subject to availability. In cases where a specific product is unavailable, we reserve the right to substitute it with an alternative product of similar style, quality, and value. If a suitable replacement cannot be provided, we will issue a full refund for the item(s) in question.

Offers and Promotion Codes  

At our discretion, we may introduce promotional offers. These offers are valid only for the stated duration and cannot be applied retroactively or after the end date.  
- Promotional offers may vary and are available only to the customers explicitly eligible for them.  
- Discounts and credits cannot be combined with any other promotions or offers.  
- Only one promotion code can be used per order unless explicitly stated otherwise.  
- Free or discounted introductory offers are limited to new customers and are restricted to one use per individual.  

We reserve the right to amend or withdraw promotions without prior notice.

Deliveries  

It is the customer’s responsibility to ensure that the recipient is within our delivery zone before placing an order. Adverse weather or other unforeseen conditions may affect delivery. In such cases, our liability is limited to a refund of the undelivered goods and associated delivery costs.

Circumstances Beyond Our Control  

Nivin Gifts and Party will not be held liable for delays or non-delivery caused by events beyond our reasonable control, including but not limited to:  
- Natural disasters or Acts of God  
- Civil unrest, terrorism, or government action  
- Adverse weather conditions  
- Mechanical or transportation failures  
- Power outages or technical issues  
- Labour strikes or industrial disputes  

Limitation of Liability  

We strive to provide a reliable and error-free service, but we cannot guarantee uninterrupted access to our services. We are not responsible for:  
- Losses not caused by our breach  
- Business-related losses, including loss of revenue, data, or goodwill  
- Indirect or unforeseen losses  

Our liability is limited to the value of the goods or services purchased. This does not affect your statutory rights.

General Terms  

Nivin Gifts and Party reserves the right to modify these terms and conditions at any time. The terms applicable to your order will be those in place at the time the order was submitted.  

If any provision of these terms is deemed invalid or unenforceable, the remaining terms will continue to apply.
